Terms and Conditions

These Terms and Conditions represent an agreement between ONLY PLANTS, Jera Skodlar, s.p. (hereinafter referred to as “ONLY PLANTS” or “we”, “us” and similar derivatives) and you. The Terms and Conditions govern the use of the website and online store at www.onlyplants.eu

2. Product Offer and Prices

  • Product descriptions, images, availability, and prices may change without notice due to the nature of online commerce.

  • All prices are listed in euros (EUR) and include VAT (unless otherwise stated).

  • Delivery costs are not included in the product price and will be shown separately at checkout.

  • Discounts, special offers, and promotional codes will be clearly marked and applied according to the stated terms.

  • Products are not suitable for children or for consumption.

We reserve the right to limit order quantities and to reject orders intended for resale.

3. Purchase Process

 1. Selecting products and cart: Choose a product and click “Add to Cart”. The cart is displayed on the right side. You may continue shopping or proceed to checkout.

2. Removing products: Edit quantity or remove products by clicking the cart icon.

3. Discount codes: If you have a valid code, enter it in the coupon field.

4. Gift wrapping: Select the gift wrapping option to send products as gifts with a personal message. Invoice will be sent only to your e-mail.

5. Checkout: Fill in billing details (name, address, phone, email). Companies must provide VAT number; consumer rights do not apply to business purchases. Enter delivery details if different.

6. Order review: Before submitting, you will see product list, prices, shipping, and total amount. Errors can be corrected before confirmation.

7. Order confirmation: The order is submitted once you click “Confirm Purchase”. You will receive an on-screen and email confirmation.

8. Order notifications:

  • Confirmation of receipt.

  • Final order confirmation or rejection. A sales contract is concluded once you receive order confirmation.

 

4. When is the Sales Contract Concluded?

The contract is concluded when you receive an order confirmation email. From that moment, all prices and conditions are fixed.

The contract consists of the order confirmation and these Terms and Conditions.

5. Payment and Invoices

Payment methods:

  • Bank transfer (pro forma invoice)

  • Credit or debit card

Payment must be made within 24 hours after confirming the order (or within 5 business days if paid via pro forma invoice). If payment is not received within this time, the contract is considered terminated.

Invoices are sent to your email.

6. Order Processing and Gift Wrapping

Standard processing and packaging are free. Gift wrapping price is included in the price of the gift packages under shop category “send a gift”.

7. Delivery and Collection

Orders are shipped after payment is received.

Delivery is available only within certain countries of EU. Delivery times are indicative and not guaranteed.

  • Free delivery for orders over €100.

  • Delivery fee is calculated at the checkout.

  • Estimated delivery time: 1–5 business days.

Personal collection is available at Celovška cesta 181 C, 1000 Ljubljana during specified working hours.

8. Our Right to Terminate in Case of Non-Collection

As our products are live plants, timely collection is crucial.
If you fail to collect products within 72 hours after attempted delivery, we may withdraw from the contract. Refunds will be issued minus any damage costs.

9. Your Right to Withdraw from the Contract (Consumers Only)

You may withdraw within 14 days without stating a reason.
You must notify us by email (info@onlyplants.eu) and return products to:
ONLY PLANTS, Jera Skodlar, s.p., Celovška cesta 181 C, 1000 Ljubljana.

Products must be returned undamaged, in original condition, and properly packaged.

You bear the return shipping cost. Refunds (including original delivery costs) will be made within 14 days of notification, but may be withheld until receipt of goods.

Withdrawal is possible only for the entire set if products are sold as a bundle.

Plants are live organisms and must be properly cared for. Improper care (watering, light, pests, diseases) is your responsibility and not grounds for withdrawal or refund.

10. Material Defects

Consumers are entitled to protection against material defects.

A defect is material if:

  • The product lacks characteristics required for normal use.

  • The product lacks characteristics for special use agreed upon.

  • The product does not match the description, sample, or model.

Due to the nature of plants, proper care and maintenance are required. Issues caused by improper care (e.g., leaf discoloration, drying, rot, pests) are not considered defects.

Defects must be reported within 2 months of discovery. Liability for defects lasts for 2 years from delivery.

If a defect is confirmed, you may request:

  • Repair of the defect

  • Partial refund

  • Replacement with a new item

  • Full refund

 

 

11. Personal Data Protection

We take your personal data protection very seriously. Details are in our Privacy Policy.

12. Limitation of Liability

You are responsible for accuracy of information provided.
We are not liable for third-party services (e.g., payment systems).

We are only liable to you for direct damages caused by gross negligence or intent. Indirect damages (e.g., lost profits, data loss) are excluded.

13. Governing Law

These Terms and Conditions and the sales contract are governed by Slovenian law.

14. Complaints and Dispute Resolution

Complaints can be submitted by email to info@onlyplants.eu.

We do not recognize any out-of-court consumer dispute resolution provider as competent.

15. Intellectual Property Rights

All content on the website, including design, photos, and texts, are protected by copyright and other intellectual property rights of ONLY PLANTS or partners. They may not be reproduced, displayed, or used without prior written consent.
